CARA JEWELLERS FZCO (collectively referred to as “Cara Jewellers,” “we,” “us,” “our”) is based in Dubai, United Arab Emirates, and owns and operates the internet website www.carajewellers.com (the “Website”).

The Conditions of Sale apply to any purchase of Cara Jewellers products or services made through the Website, associated mobile or digital applications, or by telephone via our Client Relations Center (collectively referred to as the “Platforms”).

These Conditions of Sale apply to any order placed through the Platforms or Client Relations Center (together referred to as the “Sales Channels”).

Before placing an order for products or services, you will be asked to agree to these Conditions of Sale. If you do not agree to these Conditions, you will not be able to place an order. Please note that these Conditions do not apply to sales concluded through physical retail points of sale (e.g., boutiques) or third-party authorized retailers.

2. Resgistration

3. Purchasing Eligibility

  • Only individuals who:
    • Have reached the age of legal majority and can legally enter into contracts,
    • Have the legal capacity to enter into contracts, and
    • Use a valid shipping address in the countries we ship to, as specified by the Sales Channels, may order products. If you are underage or cannot lawfully enter into a contract, you must have a parent or guardian place an order on your behalf and agree to these Conditions of Sale.

 

  • By placing an order, you confirm that you are a bona fide end-user customer purchasing for personal use and not for commercial purposes.

 

  • To make purchases, you must provide personal details such as your name, phone number, email address, and payment details, which must be valid and correct. You confirm that you are the person referenced in the billing information provided.

4. Personalized Services

  • Personalization services (such as engraving or embossing) are available on select products. To personalize your product, provide the necessary details on the Sales Channels.

 

  • We reserve the right to refuse personalized orders with objectionable, unlawful, or contrary language. Ensure all personalization details are accurate.

 

  • Orders for personalized products cannot be canceled or returned, except as per the Manufacturer’s guarantee and legal consumer rights.

5. Diamond Certificates

When ordering a loose diamond, it will be shipped with a grading report (diamond certificate). If the grading report is not included with a return, you will be charged a replacement fee of US$150 (or equivalent in other currencies).

6. Order Process

  • The order process includes:
  • Add to Shopping Bag: Add products to your shopping bag. Placing items in your bag does not guarantee availability.
  • Checkout (Guest/My Account): Proceed to checkout either as a guest or with your account. You can remove items during the process.
  • Review and Payment: Review your details and payment info. Confirm the order before proceeding.
  • Placing the Order: Confirm and place your order.

 

  • For orders through the Cara Customer Care Department:
    • Shopping for Product: A Cara Sales Expert will assist you in selecting your product.
    • Order Placement: Once selected, your personal details are added, and the order is confirmed.
    • Payment and Confirmation: After placing the order, you’ll receive an email with order details and a secure payment link.

 

  • After payment, we will process and prepare your order for delivery. If there are any concerns, contact the Cara Customer Care Department promptly.

 

  • Order acceptance is complete when your products are dispatched. You will receive a tracking number confirming shipment.

 

  • We may not accept or fulfil your order due to payment authorization issues, stock availability, shipping restrictions, or if you don’t meet eligibility criteria. We are not liable for any refusal of service.

7. Pricing

  • Prices on the product pages or quoted by Cara Sales Experts exclude shipping and taxes unless otherwise stated.

 

  • Review details carefully before completing payment. Completing payment confirms your purchase and we will prepare your order.

 

  • The applicable currency will be updated based on your delivery address and shown before you place your order.

 

  • Taxes, if applicable, will vary based on the delivery location.

 

  • Shipping costs will be added during the order process and summarized before order confirmation. Shipping exclusions apply (e.g., military addresses, restricted areas). Please contact Cara Customer Care for more details.

 

  • Prices and delivery costs are subject to change without notice.

 

  • We take reasonable care to ensure prices and delivery costs are correct, but errors may occur. If an error is found, we will contact you. If the order has been shipped, you may be asked to return the product or pay the difference.

 

  • Changes in applicable law between your order and the Confirmation of Order & Shipment may affect taxes. If taxes increase, we will contact you to reconfirm your order.

8. Payment

  • Accepted Payment Methods

Payment can be made using Visa, MasterCard, and any other payment methods that may be clearly advertised on the Website from time to time. Depending on the payment method, additional information, including forms of identification, may be required.

 

By making a payment, you expressly authorize us to perform necessary security checks and transmit or obtain updated information from third parties, including payment card details, to authenticate your identity, validate your payment card, and authorize individual transactions.

 

Once the payment is processed, the transaction will be completed, and the payment will be debited from your account. You will then be redirected to the Website. You confirm that the credit/debit card used for the payment is yours. All cardholders are subject to validation checks and authorization by the card issuer.

 

If your card issuer refuses payment, you must contact the issuer to resolve the issue. Cara Jewellers will not be liable for delays or non-delivery in such cases.

 

  • Bank Wire Transfer

We may accept bank wire transfers at our discretion. While we do not charge a fee for bank wire transfers, some financial institutions may. For orders placed by telephone, bank wire transfers must be confirmed through an approval process. Orders will not be processed until payment is received and confirmed via email. If payment is not credited within seven (7) days, the order will be cancelled.

 

  • Payment Security

We take reasonable precautions to secure our website. All credit/debit card transactions are processed through a secure third-party platform with an encrypted environment. Our website uses SSL certificates to ensure a safe and secure shopping experience.

 

We take all reasonable care to protect your order and payment details. However, in the absence of negligence on our part, we are not liable for any loss suffered due to unauthorized access to your data.

9. Shipping Policy

We accept orders only for delivery to the countries identified during the order process. Please note that we do not ship to certain addresses, including military areas, restricted zones, P.O. boxes, or pick-up points. For more details, please contact our Customer Care Department.

 

Boutique Pickup

For certain locations, we offer free boutique pick-up. Please refer to the Platforms or contact Customer Care for more information. We will notify you when your product is ready for pick-up.

 

Shipping of Multiple Products

If you order multiple products, we will only ship once all items are available. Partial shipments will only occur if otherwise communicated.

10. Delivery

  • Free Worldwide Shipping

We offer free shipping worldwide, except to certain countries such as Oceania, Kosovo, North Korea, Sierra Leone, South Sudan, and others. Please refer to the list in the original content for excluded countries.

 

  • Estimated Delivery Time

We will make reasonable efforts to ensure delivery within the estimated time, starting from the date of written Confirmation of Order & Shipment. In any case, delivery will occur within thirty (30) days, unless the product requires additional time for customization or production.

 

  • Delivery Delays

If delivery is delayed due to circumstances beyond our control, we will inform you promptly and work to minimize the delay. If we do not deliver within thirty (30) days from the Confirmation of Order & Shipment, you may cancel the order and receive a refund for any undelivered items.

 

  • Remedy for Delivery Failure

Your sole remedy for failure to receive your order will be the option to cancel the order and receive a refund for undelivered items.

 

  • Delivery Time Considerations

Delivery time estimates account for credit approval, address verification, security checks, and order processing. Delivery is subject to full payment.

 

  • Shipping Insurance & Responsibility

We insure all purchases during transit until delivery. A signature will be required upon delivery, and the responsibility for the purchased product transfers to you at that point. If the recipient is not you, evidence of a signature from them will serve as proof of delivery and fulfilment.

11. Invoices

  • Upon ordering via the Sales Channels, you will receive an invoice in writing, sent to your email address as a PDF attachment or in another format.

12. Repairs

  • For any repair inquiries relating to a product ordered through the Sales Channels, please contact Cara Customer Care Department, who will explain to you the process and will send you a Shipping Kit with the necessary material for you to send us your product for Service.

     

    Once you have received the Shipping Kit, comprising a Service Request Form, a product box, an outer box/envelope, pre-printed return label with our address and a pre-paid label as applicable (collectively the “Shipping Kit”), please:

    • Include the duly completed and signed Service Request Form, the Cara Jewellers product and all its accessories in the product box, and the International Guarantee or a valid proof of purchase/ service, as applicable, and all other documents in the outer box/envelope, Seal the outer box/envelope and affix the pre-printed return label or the pre-paid label, as applicable, and Send back the outer box/envelope to the address of the Cara Jewellers Service Center indicated on either label.

    For security reasons, the Shipping Kit boxes will be unbranded.

    You must keep a proof of shipment. Only products received by the Cara Jewellers Service Center will be eligible for the Service, in accordance with these Conditions of Service.

    Once the Service has been performed by Cara Jewellers in accordance with the Cost Estimate that you validated, and after receipt of your payment in full, Cara Jewellers will then send the repaired jewellery (together with your guarantee card if any) back to the shipping address you indicated on the Service Request Form.

    Please note that you can only change the shipping address to where the repaired product will be returned before placing your Service Order, but not afterwards.

    We only accept Service Orders for delivery to the United Arab Emirates. Please note that we do not ship to certain addresses, such as military, certain restricted areas (such as hotels) or P.O. boxes. For further information, please contact the Cara Customer Care Department.

13. Product Descriptions

  • We try to ensure that the information, including product descriptions, dimensions, and colours, provided on the Platforms, in advertisements or catalogues or as provided by the Cara Customer Care Department is accurate and complete. However, we make no guarantees, whether express or implied, in relation to the accuracy, reliability and completeness of such information. In particular, any description and information concerning the weight of precious materials and the number of stones and carats are provided as an indication only and may vary slightly.

14. Limitation of Liability

  • To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties in relation to the products and Sales Channels whether express or implied by statute or otherwise or arising from any previous course of dealing or usage or trade practice.

     

    Nothing in these Conditions of Sale limits or excludes our liability for any liability which cannot be limited or excluded by applicable law. Subject to the preceding sentence, our aggregate liability to you under these Conditions of Sale for any order whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages shall in no event exceed the one hundred percent (100%) of the price of the product(s) in your order.

     

    Please note that in some jurisdictions consumer protection laws may not allow certain exclusions or limitation of warranties or liabilities, and consequently some of the above exclusions and limitations may not apply.

15. General Provisions

    • If any provision, or part of a provision, of these Conditions of Sale is found to be illegal, invalid or unenforceable, that provision or part-provision shall be deemed not to form part of these Conditions of Sale, and the legality, validity or enforceability of the remainder of the provisions of these Conditions of Sale shall not be affected, unless otherwise required by operation of applicable law.

     

    • These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

     

    • We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

     

    • The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

     

    • This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable Cara Jewellers Guarantee.

16. Information On Our Site

    • At Cara Jewellers, we make every attempt to ensure that our online catalog is as accurate and complete as possible. In order to give you the opportunity to view our products in great detail, some products may appear larger or smaller than their actual size in our photographs; and since every computer monitor is set differently, colour and size may vary slightly.

       

      Our objective is to provide you with as much information and detail about your prospective purchase as possible so that you can see the beauty and shape of a particular item. On the Site, we provide the measurement of our products based on our manufacturing specifications. Slight tolerances may be accounted for based on finishing during the manufacturing. For diamond jewellery set with multiple diamonds, we provide the minimum total carat weight for the piece. Colour and clarity grades are expressed as an average depending on the number of diamonds wherein the quality is equal to or exceeds the grade stated.

17. Policy On Ethical Sourcing

    • At Cara Jewellers, we only purchase diamonds through the largest and most respected suppliers who, like us, proudly adhere to and enforce the standards established by the Kimberley Process, an international system that polices the trade of diamonds to ensure they are from sources free of conflict

18. Use Of Website Content

      • All information, text, materials, graphics, products, product names, images, designs, tag lines, logos, button icons, images, video and audio clips, trademarks, trade names, service names (whether registered or not), advertisements, layout, arrangement, graphical user interface, look and feel, and control features of the Website (collectively, “Website Content”) is provided to you as a service to allow you and other users to browse our products and services.

       

      • You are only permitted to access and use this Website for your personal, non-commercial purposes, and you must not:
